About the Rulemaking Process

The North Carolina State Lottery Commission is responsible for adopting the rules that governs sports and horse race wagering in North Carolina. The rules ensure that wagering is done fairly and responsibly.

In September 2023, the Commission adopted the Rulemaking Policy and Procedure to establish a transparent deliberative rulemaking process. Taking into consideration the evolving nature of authorized gaming and wagering in North Carolina, this rulemaking policy provides the Commission flexibility to act in a timely manner to serve the public interest while including provisions that ensure the general public and all stakeholders have an opportunity to be heard through public comment.

A rulemaking process starts as Commission staff proposes rules for sports and horse race wagering. Those rules are then made available to the public for feedback. After the public comment period is over, staff will review comments and revise rules if necessary before going back to the Commission for a vote to adopt the rules.

All rules adopted by the Commission are in the North Carolina State Lottery Commission Rules Manual for Sports Wagering and Pari-Mutuel Wagering. The rules can also be found in Chapter 6 of the North Carolina Administrative Code, Title 24, Independent Agencies.
